If you were treated badly or cannot get an appointment, make a complaint on the «Quejas y Sugerencias» form of the SEPE e-office. If you disagree with a decision on your benefit, file a formal claim through a registry within 30 days.

A complaint (queja) is not an appeal: it does not change any decision and it does not stop any deadline. If you disagree with what SEPE decided, file the formal claim (reclamación previa), even if you also want to complain.

How to make a complaint to SEPE

SEPE has no complaints book like a shop. To complain, you use the «Quejas y Sugerencias» (complaints and suggestions) form.

  1. Open the form.

Go to the SEPE e-office (sede electrónica), open «Otros trámites y procedimientos» and click «Quejas y Sugerencias». You log in with Cl@ve, a digital certificate or an electronic DNI.

    Official SEPE Portal

  2. Say what happened. Write the date, the office or the phone line you called and what happened, in a few sentences.
  3. Save the receipt. Download it when you finish. It proves that you sent the complaint.

Form not working? Write your complaint in a document and send it through the General Electronic Registry. As the recipient, choose the SEPE Provincial Directorate of your province. It accepts Cl@ve PIN. Without internet, hand in the letter at a public registry office.

Keep in mind SEPE has no email address for complaints. The address ssccquejas@sepe.es is shared on social media, and SEPE itself has said it is not correct.

Formal claim: if you disagree with a decision

Use it if your benefit or subsidy is refused, if you disagree with the amount or the duration, if SEPE asks you to pay money back, or if you disagree with the option applied when you resume your benefit. You have 30 days from the date you are notified of the decision.

  1. Write the letter. Include your full name, your DNI or NIE, your address if it has changed, which decision you do not accept and why. End with the place, the date and your signature. You can attach documents that support you.
  2. Address it correctly. The recipient is the Subdirección de Prestaciones (benefits department) of the SEPE Provincial Directorate in the province where you live.
  3. File it through the registry.

Log in to the General Electronic Registry with Cl@ve PIN, Cl@ve permanente, a digital certificate or an electronic DNI. Choose the SEPE Provincial Directorate as the recipient and attach your letter.

  4. Save the receipt. You need it if you go to court later.

Without internet, file it at a public registry office, at a post office as correo administrativo (official registered post) or at your benefits office with an appointment. Do not use the «Gestión de la documentación» service on the e-office: it does not accept formal claims.

What happens next

Complaint. The unit concerned replies within 20 days. If it does not, you can contact the SEPE Inspectorate of Services (Inspección de Servicios).

Formal claim. SEPE must reply within 45 days. No reply means it is refused (silencio administrativo). From the refusal, by letter or by silence, you have 30 days to take your case to the social court (Juzgado de lo Social). The receipt of your claim goes with your court claim.

While you wait, you can check the status of your claim in the Área Personal.

Do you need a lawyer to challenge a SEPE decision?

No. You write and file the formal claim yourself, and it is free. If SEPE rejects it, you have 30 days to go to the social court, the Juzgado de lo Social (Law 36/2011, art. 71), and at that first hearing a lawyer is not compulsory either (art. 21). Help is worth it if SEPE asks you to pay back a lot of money, stops your benefit as a penalty or you go to court. As a beneficiary you have the right to a free duty lawyer in social cases (Law 1/1996, art. 2.d); a trade union or a graduado social can also help. Fees are set freely: ask for a written quote first and be wary of anyone who guarantees the result.

Frequently asked questions

Do I need a lawyer for the formal claim?

No. It is your own letter to SEPE and you can file it yourself.

Does a complaint or a formal claim cost money?

No. Both are free, just like the appointment.

Can I file a claim if SEPE never answers my benefit application?

Yes. After three months with no reply, the application counts as refused and from that day you have 30 days to file the formal claim.

Can I make a complaint and a formal claim at the same time?

Yes. The complaint does not take away any right and does not replace the claim.
