Lawyer to appeal an immigration refusal in Spain
Has your residence permit, visa or renewal been refused? You have one month for an administrative appeal (recurso de reposición) and two months to go to court. Tell us about your case and we will put you in touch with a registered lawyer in your province.
Your deadlines
| Appeal | Deadline | Lawyer |
|---|---|---|
| Administrative appeal (reposición) | One month | No fee. You can file it yourself. |
| Court appeal (contencioso-administrativo) | Two months (six against a silence) | You need a lawyer. |
The deadline starts the day after you are notified. August does not count for the court deadline, but it does for the administrative appeal.
When a lawyer is worth it
- You are going to court: a lawyer is required there.
- The refusal includes an order to leave.
- You have a criminal record or you do not understand the reason for the refusal.
If your income is low, you can ask for free legal aid (asistencia jurídica gratuita). Foreign nationals have this right too.

Frequently asked questions
Can I appeal without a lawyer?
Yes, you can file the administrative appeal (recurso de reposición) yourself, within one month and with no fee. To go to court (contencioso-administrativo) you need a lawyer.
Does an appeal stop the refusal?
Not on its own: filing an appeal does not suspend the decision. If the refusal includes an order to leave, raise it with the lawyer as soon as possible.
How much does the lawyer cost?
Each lawyer sets their own fees: ask for the price before you hire them. Getting in touch through Ayuda Trámites is free for you.
Does sending a request stop my deadline?
No. The deadline keeps running from the day after you were notified. If it ends in a few days, contact a lawyer directly.
